HS 26: Human Rights in Central and Eastern Europe
Equality in Central and Eastern European Constitutionalism

This talk will explore how constitutions - constitutional courts in particular - in Central and Eastern Europe engage with human rights, especially the principle of equality and the prohibition of discrimination. Examples from Czechia will be used for in-depth analysis. The legacies of the countries’ state socialist past on one hand and newer external influences, such as the Germanic neighbouring legal systems, EU membership, and - Western and often common-law based – theories of equality, on the other hand, will be examined.
